Prairie Gator Tote Rental Store Policy Terms & Conditions Effective for new acceptances: October 23, 2026 Policy version: PGTR-2026-10-23-v3 Contact: 352pgtr@gmail.com This policy applies to Prairie Gator Tote Rental (PGTR) moving totes and rented accessories. Your confirmed order identifies the equipment, price, rental dates, service address, and delivery and pickup times. Please read and accept these terms before paying for a rental. CHARGES Damaged, lost, stolen, destroyed, or unreturned tote — $10.00 per tote Customer no-show or lack of readiness after the grace period — $30.00 per appointment Ordinary cosmetic wear from proper use — No charge 1 Reservations and the rental period A booking request becomes a reservation only when PGTR confirms it. Standard packages include a two-week rental unless your order states otherwise. Rental possession begins when equipment is handed to you or your authorized adult representative, or placed according to written instructions accepted by both parties. 2 Customer custody and ownership You have sole responsibility for the care, security, and proper use of rented equipment while it is in your possession or control. Return it in the condition received, ordinary wear excepted. Your movers, household members, employees, and representatives do not relieve you of that responsibility. PGTR retains ownership. Do not sell, lend, subrent, alter, or discard the equipment. Custody ends when PGTR receives and records its return or accepts a different handoff in writing. You are not responsible for pre-existing defects or loss caused by PGTR. 3 Delivery and pickup grace period Both the customer and PGTR receive a 30-minute grace period after the confirmed appointment start time. A customer must be available and ready within 30 minutes. To protect the customer when PGTR arrives late, the customer grace period begins at the later of the confirmed time or PGTR arrival and contact attempt. An early arrival does not start the clock early. If PGTR is present and the customer is unavailable or not ready when that full grace period expires, one $30.00 fee will be charged for that missed appointment. PGTR may leave and reschedule. The fee applies separately to delivery and pickup, not to each additional 30 minutes. PGTR will document its arrival and attempt to contact the customer before leaving. If PGTR has not arrived within 30 minutes after the confirmed start time, the customer may reschedule without a no-show or rescheduling charge and does not have to keep waiting. PGTR delays do not create customer no-show fees or additional rental charges caused solely by that delay. For example, if both parties are scheduled for 10 a.m. and PGTR arrives on time, the customer has until 10:30 a.m. to be ready. 4 Access and readiness Provide the correct address, working contact number, gate codes, parking instructions, and any access restrictions before the appointment. An adult age 18 or older must receive delivery or release equipment unless PGTR has approved written unattended handoff instructions. At pickup, totes must be empty, reasonably clean, dry, and accessible with lids and rented accessories together. Blocked access or equipment that is not ready may count as a missed appointment under Section 3. Approved unattended service does not require the customer to be present. 5 Inspection and condition records PGTR will provide equipment in usable condition. Check the quantity, lids, handles, and rented accessories at delivery, and tell PGTR about visible damage or shortages before use or within 24 hours. Report a hidden defect promptly after discovering it. Stop using equipment that appears unsafe and contact PGTR for a replacement or other appropriate remedy. A late report does not automatically make you responsible for a defect that existed before delivery. PGTR may document equipment condition and counts at delivery and return. 6 Damaged lost or stolen totes You must pay $10.00 for each tote damaged beyond ordinary wear, destroyed, lost, stolen, or not returned while in your custody, except to the extent caused by PGTR or a pre-existing defect. This charge covers one complete tote and its lid. A missing or unusable lid may require replacement of that tote; the total replacement charge for the same tote and lid will not exceed $10.00. Chargeable damage includes cracks, broken handles or lids, burns, permanent alterations, and contamination that makes a tote unsafe or unsuitable for another rental. Minor scuffs from proper use are ordinary wear and are not charged. Notify PGTR promptly of damage, loss, or suspected theft. PGTR will provide an itemized explanation and available condition records before collecting a replacement charge. Theft by another person does not remove your replacement responsibility while equipment is in your custody, subject to the exceptions above. Do not substitute a personally purchased tote without PGTR approval. A replacement charge is compensation for the missing or damaged equipment, not permission to keep PGTR property. If a tote previously charged as lost is recovered and returned in acceptable condition, PGTR will credit or refund its replacement charge. PGTR will not collect repair and full replacement charges for the same tote. 7 Safe use and secure storage Use totes and dollies only for ordinary household or office moving and storage. Follow marked manufacturer limits and PGTR safety instructions. Do not overload totes, create unstable stacks, stand or sit on them, or allow children to play in them. Protect equipment from traffic, weather damage, heat, and theft. Totes are not safes, and a lid or zip tie is not a guarantee against theft or water intrusion. Do not use equipment for hazardous, flammable, toxic, illegal, leaking, or contaminating materials, or to transport people or animals. Wrap breakable belongings, lift safely, and use only approved removable labels. Keep equipment secure; do not leave it unattended on a curb or in a public area without written PGTR approval. 8 Changes cancellations and overdue equipment Request cancellation or rescheduling at least 24 hours before your confirmed appointment whenever possible. Contact PGTR promptly if plans change. Website requests and requested extensions are subject to PGTR confirmation and equipment availability. Existing confirmed dates remain in effect until PGTR accepts a change. Request extra rental time before pickup. Any extension price or separate cancellation, late-return, cleaning, or accessory replacement charge must be disclosed in your order and accepted before it applies. This policy does not create an unspecified fee. The $30.00 missed-appointment charge and $10.00 tote charge apply as stated above. If equipment remains unreturned after a written request and reasonable opportunity to return it, PGTR may assess the applicable replacement charge and pursue lawful recovery. A late return is not automatically an allegation of theft. 9 Payments and additional charges Pay rental charges by the deadline in your confirmed order and before delivery unless PGTR agrees otherwise in writing. PGTR may invoice the agreed charges in this policy after documenting the reason and amount. Any later charge to a stored payment method requires separate, valid payment authorization and compliance with the payment processor rules. Accepting this policy alone does not authorize unlimited or undisclosed charges. Ask PGTR to review any billing concern promptly; your lawful payment-dispute rights remain intact. If you separately check the saved-card authorization box at checkout, you authorize PGTR to have Stripe securely save your card and initiate an unscheduled $30.00 payment for each qualifying missed confirmed delivery or pickup appointment under Section 3. This is limited to one $30.00 fee for that appointment, not a repeating charge for every 30 minutes. The customer grace period and PGTR-delay protections in Section 3 still apply. PGTR or its driver must document arrival, an attempt to contact you, and your absence or lack of readiness after the full applicable grace period before initiating a fee. A separate missed pickup may incur its own fee. PGTR may initiate the authorized fee after verifying the missed appointment, and will make a record of the amount and reason available with a payment receipt when payment succeeds. This authorization does not cover tote replacement, cleaning, extensions, cancellation, or other charges. Those require their own applicable authorization or invoice. Card payments can be declined or require additional authentication; an unsuccessful attempt is not a collected payment. Contact 352pgtr@gmail.com to withdraw permission for future saved-card charges or dispute an assessment. Withdrawal does not erase an amount already validly owed; PGTR may invoice it. PGTR retains a dated record of the authorization and the terms accepted. 10 Customer belongings and PGTR liability PGTR provides rental equipment and the delivery and pickup services listed in your order. You are responsible for packing, loading, lifting, transporting, storing, and protecting your belongings unless a separate written agreement assigns a task to PGTR. PGTR does not insure your belongings or guarantee protection against theft, moisture, breakage, or losses caused by improper packing or misuse. Consider whether your own insurance covers your move. To the extent permitted by law, PGTR is not responsible for loss or injury caused by customer misuse, unsafe loading, unauthorized alterations, or third parties outside PGTR control. The customer is responsible for third-party claims and reasonable, documented losses to the extent caused by the customer's negligence or unauthorized use of equipment. This responsibility does not extend to PGTR negligence or misconduct. To the extent permitted by law, PGTR liability for an ordinary breach of the rental agreement is limited to the rental fees paid for the affected order, and excludes indirect or consequential losses such as lost profits or business interruption. These limits do not apply to injury or property damage caused by PGTR negligence, gross negligence, intentional misconduct, fraud, or any liability or consumer remedy that cannot lawfully be excluded. This policy does not waive those rights. 11 Unsafe conditions and delays PGTR may pause or reschedule service if weather, access, equipment condition, or conduct creates a safety risk. PGTR will communicate a revised plan as soon as practicable. The customer will not owe a no-show fee when PGTR cancels or reschedules for its own delay or safety decision, unless a documented customer access or readiness problem independently meets Section 3. No extra charge applies solely because of a PGTR-caused pickup delay. 12 Client information and encryption PGTR protects client information submitted through its website using encryption in transit and stores booking records using provider-managed encryption at rest. Access is limited to authorized personnel and service providers who need the information to process rentals, payments, delivery, pickup, customer support, or legally required records. Booking email and calendar notifications are handled by the relevant service providers and are not promised to be end-to-end encrypted. Please do not send card numbers, passwords, Social Security numbers, or other sensitive identification in booking notes or email. When online payment is enabled, payment card details are processed through Stripe; PGTR does not store full card numbers in its booking database. PGTR does not sell customer information. We share it only as needed to fulfill your rental, operate necessary service providers, address claims, comply with law, or as you authorize. We retain records only for legitimate business and legal needs and use reasonable safeguards for disposal. No security system can guarantee absolute protection. Contact 352pgtr@gmail.com about privacy or correction requests. 13 Governing law and agreement changes Florida law governs this agreement, subject to applicable consumer protections. Please contact PGTR first to discuss a concern; this does not restrict your right to seek a lawful remedy. This policy and your confirmed order form the rental agreement. A specific exception or change must be accepted by both parties in writing. New policy versions apply to future rentals unless you expressly accept a change for an existing order. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. 14 Customer acknowledgment By signing or affirmatively accepting this policy at checkout, I acknowledge that I received and can retain a copy, am at least 18 years old, and have authority to enter this rental agreement. I accept responsibility for rented equipment while in my custody and understand the $10.00 per-tote replacement charge and $30.00 missed-appointment charge after the applicable 30-minute grace period. I understand that separate consent is required for later charges to a stored payment method.
